1. Introduction:  

Welcome to Hidayah & Co, Beauty in Modesty. These Terms & Conditions (“Terms”) govern your use of our website, www.hidayahandco.com, and all related services, products, and features offered through it. 

By accessing or using our website, you agree to comply with and be legally bound by these  Terms. Please read them carefully before using the website. If you do not agree with any part of these Terms, you must not access or use the website. 

These Terms apply to all visitors, users, and others who access or use the service. 

2. Eligibility to Use: 

You must be at least 18 years old to use this website, or access it under the supervision of a parent or legal guardian. By using the site, you confirm that you are legally capable of entering into a binding contract and are not prohibited from using the services under any applicable laws. Hidayah & Co reserves the right to deny access or terminate accounts of users who violate this provision.

4. Products and Orders: 

▪ Product Descriptions: We try to display all products accurately, including colors,  styles, and fabric details. However, slight variations may occur due to photography  lighting and device screen settings. 

▪ Availability: Product availability is subject to change without notice. We may limit  quantities or discontinue any product at our sole discretion. 

▪ Pricing: All prices are in Indian Rupees (INR) and include applicable taxes unless  otherwise stated. Prices and offers are subject to change without prior notice. 

▪ Order Confirmation: Once you place an order, you will receive a confirmation email.  This does not signify acceptance of your order but confirms we have received it. Final acceptance occurs upon dispatch. 

▪ Order Cancellation: 

  • You may cancel your order before it is shipped by contacting our support team. 
  • Hidayah & Co reserves the right to cancel any order due to product unavailability, pricing  errors, or suspected fraudulent activity. 

▪ Custom & Pre-Orders: 

  • Pre-order and made-to-order items require full payment in advance and are non cancellable and non-returnable. 
  • Estimated delivery dates will be provided at the time of order but are subject to reasonable delays. 

▪ Gift Packaging: 

  • Gift packaging is available at an additional charge. You can opt for this at checkout.
  • Personalized messages may be included if requested. 

▪ Bulk Orders: 

  • For bulk or group orders (10 or more pieces of the same item), please contact us directly  for custom pricing and timelines. 
  • Bulk orders may require additional processing time and are typically non-returnable  unless defective.

5. Pricing and Payment Terms 

▪ Prices: 

All product prices are in Indian Rupees (₹) and include taxes unless we say otherwise. We  may update prices anytime without notice. 

▪ Payment Methods: 

You can pay using: 

  • UPI (Google Pay, PhonePe, etc.) 
  • Credit/Debit Cards 
  • Net Banking 
  • Cash on Delivery (COD) – currently unavailable 
  • Order Confirmation: 

Your order is only confirmed once we receive full payment (except for COD orders). You’ll get an email with order details after placing the order. 

▪ COD (Cash on Delivery): 

  • Please make full payment to the delivery person when your order arrives. 
  • Refusing COD orders repeatedly may block future COD access. 

▪ Offers & Discounts: 

We may offer promo codes or discounts. They must be used before expiry and as per terms mentioned. Only one code can be used per order (unless stated). 

▪ Billing: 

You’ll get a bill/invoice with every order showing item details, tax, and total amount  paid. 

6. Loyalty Points Programme: 

▪ Earning Points 

Customers will receive 5 loyalty points for every ₹100 spent on eligible purchases. Points are calculated on the net bill amount after any applicable taxes and discounts. 

▪ Point Value 

Each loyalty point holds a value of ₹1. 

▪ Validity 

Loyalty points are valid for 6 months from the date of issuance. Expired points cannot  be reissued or reinstated.

▪ Redemption Limit 

A maximum of 250 loyalty points can be redeemed per bill/transaction. Partial usage  or splitting of points across multiple bills is not allowed. 

▪ Exclusivity 

If loyalty points are applied to an order, no other coupon codes or promotional offers can be used in the same transaction. 

▪ Order Cancellation 

If an order where loyalty points were redeemed is cancelled by the customer, the  redeemed points will be forfeited and will not be re-credited. 

▪ Non-Transferable & Non-Refundable 

Loyalty points are non-transferable, non-exchangeable, and cannot be converted into  cash or refunded under any circumstances. 

▪ Discretion 

The company reserves the right to modify, suspend, or terminate the loyalty  programme at any time without prior notice. 

7. Shipping and Delivery:  

▪ Shipping Locations: We deliver across India through reputed courier partner Shiprocket. For international orders, please check availability or contact us before ordering. 

▪ Shipping Time: 

  • Orders are usually shipped within 3–5 working days. 
  • Delivery may take 5–15 working days, depending on your location. 
  •  Pre-orders or custom-made items may take longer. 

▪ Shipping Charges: 

  • Shipping is free on orders above Rs 1599/- 
  • A small fee may apply to smaller orders or remote areas. 
  • Charges will be shown at checkout before you pay. 

▪ Delivery Delays: 

Sometimes, delays can happen due to weather, festivals, or courier issues. We’ll do our  best to keep you updated. 

▪ Tracking: 

Once your order is shipped, you’ll get a tracking link by email or WhatsApp. 

▪ Missed Delivery: 

If you're not available during delivery, the courier will usually try again. If the order is  returned to us, we can resend it (extra charges may apply). 

8. Returns, Exchanges, and Refunds 

We accept returns or exchanges only under the following conditions: 

▪ The product is defective or damaged upon delivery. 

▪ A return/exchange request must be raised within 24 hours of receiving the order.

▪ To initiate the return, the customer must email us within 24 hours at customercare.hidayah@gmail.com Or Raise a Ticket and provide: 

  • An uninterrupted unboxing video of the package 
  • Clear photos of the damaged or defective items (if required) 

▪ The item must be unused, with original tags and packaging intact. 

▪ Non-defective items are not eligible for return or exchange. 

▪ Shipping and handling charges are non-refundable. 

▪ We are not responsible for any lost or damaged packages during return transit. 

▪ Orders can be cancelled within 24 hours from the time of placing the order. 

▪ Approved refunds will be processed within 5–7 business days.

9. Intellectual Property Rights 

▪ Everything on our website — like designs, photos, logos, content, and style — belongs to  Hidayah & Co. 

▪ You can’t copy, use, share, or sell anything from our website without our written  permission. 

▪ Our brand name, product images, and website content are legally protected. 

▪ If you use our content without permission, we may take legal action. 

10. Limitation of Liability 

▪ We do our best to keep product details and website content accurate and updated. 

▪ Sometimes, unexpected issues (like delays, errors, or technical problems) may occur. 

▪ Hidayah & Co is not responsible for any indirect or accidental loss while using the  website. 

▪ We are not liable for delays caused by external factors like courier delays, weather, or  technical errors. 

▪ In any case, our responsibility will be limited to the amount you paid for the product. 

▪ By using the website, you agree to do so at your own discretion and risk.

11. User Conduct & Restrictions 

▪ Users are expected to use the website in a lawful, respectful, and responsible manner. 

▪ Providing false information or impersonating another person is strictly prohibited. 

▪ Users must not attempt to hack, disrupt, or interfere with the website’s security or  functionality.

▪ All content on the site (images, text, designs) is the property of Hidayah & Co and must  not be copied, reproduced, or used without written consent. 

▪ Uploading or sharing content that is harmful, offensive, misleading, or violates any law is  not allowed. 

▪ Any misuse of the website may result in account suspension, blocked access, or legal  action. 

▪ Hidayah & Co reserves the right to monitor activity and enforce these rules as necessary. 

12. Termination and Suspension 

▪ Hidayah & Co reserves the right to suspend or terminate your access to the website at  any time, without notice, if we believe you have violated our Terms & Conditions,  policies, or applicable laws. 

▪ Your account may also be suspended or limited if we detect: 

  • Fraudulent or suspicious activity 
  • Abuse or misuse of the website 
  • Non-compliance with return or cancellation rules 
  • Use of false identity or information 

▪ In serious cases, legal action may be taken, and any pending orders may be cancelled  without liability.

13. Governing Law & Jurisdiction 

▪ These Terms & Conditions shall be governed by and interpreted in accordance with the  laws of India. 

▪ In case of any disputes, the matter shall be subject to the exclusive jurisdiction of the  courts in Vapi–Valsad, Gujarat. 

14. Dispute Resolution

▪ We aim to resolve all concerns promptly and within 7 working days, through direct  communication.

▪ If the issue cannot be resolved through mutual discussion, the matter may be taken to  court as per the laws of India. 

▪ All disputes shall be subject to the exclusive jurisdiction of the courts in Vapi–Valsad,  Gujarat. 

15. Force Majeure 

Hidayah & Co shall not be held responsible for any delay or failure in performance caused by  events beyond our reasonable control. These events may include (but are not limited to): 

  • Natural disasters (floods, earthquakes, storms) 
  • Acts of God 
  • War, riots, or civil disturbances 
  • Government restrictions or lockdowns 
  • Fire, explosions, or accidents 
  • Internet or power outages 
  • Pandemic-related disruptions 
  • Courier or transport failures 

In such cases, we will make every effort to resume normal service as soon as possible, but we  shall not be liable for any resulting delay or non-performance. 

16. Amendments to Terms 

▪ Hidayah & Co may update, change, or revise these Terms & Conditions at any time,  without prior notice. 

▪ Any changes will be posted on this page with an updated “Effective Date.”

▪ Revisions become effective immediately upon posting, unless specified otherwise. 

▪ Users are encouraged to check this page regularly to stay informed. 

▪ Continued use of the website after changes are posted means you agree to the updated  Terms.
